Terms of service

These terms govern any engagement between you (“Client”) and Jackson Web Architecture (“JWA”). This document is a working draft and not yet legal review-grade. Verify with your own counsel before relying on it.

The plain-English summary

Before the formal language, here's what this agreement actually says:

  • The work begins with immediate effect after you request it and pay for it. There's no chargeback window, no wait period, no “cooling off” — once a fee is paid it's not refundable.
  • Recurring tiers (Core, Growth, Care Plan, Advisory) are billed monthly in advance. You can cancel with 30 days' notice. You don't pay for periods you haven't used, but periods already paid aren't refundable either.
  • One-off services (Website Build, GBP Reinstatement, SEO Ranking Recovery) are scoped pieces of work with quoted prices. Work begins on receipt of payment.
  • I commit to performing the work to the standard described in each tier — not to specific outcomes. Rankings, traffic, conversions, Google's algorithm decisions, third-party platform changes: those aren't anyone's to promise. Honest timing expectations appear in the FAQ of each service page.
  • The lowest tiers are data-only (Advisory): you keep the dashboard history, no work is performed, no report-review promise applies.

With that in mind, the formal terms below.

1. Services

JWA provides services as described in the engagement contract signed between Client and JWA. The full contract is the binding instrument; this page summarises the agreed terms.

2. Payment terms

  • Recurring fees are billed monthly in advance, due on the 1st of each calendar month.
  • One-off fees are billed upfront before work commences.
  • No chargebacks. All fees are non-refundable. The work begins with immediate effect after payment — the audit starts, the credits get consumed, the on-page fixes get pushed, the GBP posts start drafting. Once paid, fees are not returned.
  • Late payment: a 7-day grace period; then we retry the card via Stripe / GoCardless. Failed payments trigger the platform's auto-retry schedule (Day 3, 7, 14). After 14 days of failed payments the dashboard goes into read-only mode; after 30 days the account is paused.

3. Cancellations

  • Recurring engagements: 30-day rolling notice. Cancellations mid-period don't refund the period already paid. The next billing cycle does not occur after the 30-day notice period ends.
  • Website build: deposits non-refundable once work has started; remaining balance due on completion.
  • PPC management: 30-day notice on the management fee; ad spend continues with Google until you cancel directly in your own Google Ads account.
  • One-off services: the work begins on receipt of payment. Non-refundable.
  • At cancellation, you are offered the Advisory tier (£80/month) instead of losing the dashboard history entirely. The Advisory offer names what stops (active posting, optimization, outreach, monthly reviews) before it names the price, per the brand ethos.

4. Outcome and timing expectations

JWA commits to performing the work described in each tier to a consistent standard (personally reviewed, not auto-published). JWA does not commit to specific outcomes. In particular:

  • No guarantee of ranking positions, traffic levels, revenue, leads, conversion rates, or any other outcome metric.
  • Search engine algorithm updates, third-party platform decisions, audience reception, and competitive moves by other businesses: outside anyone's control.
  • Realistic timing ranges are stated on each service page's FAQ section and in writing before engagement begins. These ranges are honest expectations, not commitments.

5. PPC-specific terms

By engaging JWA for PPC management you confirm:

  • You authorise JWA to manage your Google Ads account via Manager (MCC) link.
  • All ad spend is billed by Google directly to your payment method on file with Google.
  • JWA's fee covers management service only and explicitly excludes any liability for ad spend, billing disputes, or Google's account decisions.
  • You agree to maintain a minimum ad spend of roughly £1,000/month to ensure statistical significance of performance data.

6. Data ownership on termination

  • Your business data, keyword ranking history, backlinks profile, GBP insights, and social engagement data: you retain ownership throughout the engagement and after.
  • On termination: full CSV + JSON export within 14 days. After that, business-name + anonymised aggregate snapshots may be retained for case-study purposes (opt-out available).
  • The dashboard platform itself (the code, the schema, the UI) is the property of JWA. You're a subscriber, not a licensee.

7. Liability limitations

JWA's total liability under any engagement is limited to the fees paid by Client in the 3 months preceding any claim. JWA is not liable for indirect, consequential, or punitive damages. JWA is not liable for changes to third-party platform algorithms (Google, Meta, Bing), for ranking fluctuations, or for the outcomes of service-provider-specific decisions.

8. No outcome guarantees

SEO, social media management, GBP posting, citation building, backlink outreach, and PPC management all involve variables outside JWA's control (search engine algorithms, third-party platform policies, audience reception). JWA commits to performing the work to the standards described in the engagement contract; specific outcomes (rankings, traffic, conversions) are not guaranteed unless explicitly stated in writing.

9. Minimum timeframes for results

Realistic ranges — stated honestly:

  • Local SEO / Maps pack rank movement: 3-6 months of consistent work for meaningful gain.
  • PPC: clicks from day one but meaningful performance stabilises over 4-8 weeks.
  • Website builds: 4-8 weeks kickoff to launch.
  • PPC performance reviewer: weekly cadence, full review month-end.

If you need a specific result by a specific date, raise it before signing and JWA will tell you honestly whether it's achievable in your timeframe.

10. PECR / GDPR compliance

For any feature that constitutes electronic marketing under PECR (UK's privacy and electronic communications regulations), including the backlink outreach engine, we apply the same compliance rules detailed in the Privacy Policy: sole-trader / partnership / unknown-entity businesses can only be reached by letter or phone, never by email or SMS.

11. Governing law

This agreement is governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.

12. Acceptance

By signing the engagement contract, the Client agrees to these terms as a non-severable part of that contract.
